Defendant entered an appearance promptly upon receiving actual notice of the matter. Therefore, the Court hereby ORDERS that the entry of default 16 be set aside. See Fed. R. Civ. P. 55(c). Based on the stipulation of the parties, this Court further ORDERS that the case is dismissed with prejudice and each party shall bear its own fees and costs. See Fed. R. Civ. P. 41(a)(1)(A)(ii).
