MINUTE entry before the Honorable Jeffrey I Cummings: The Court has reviewed the parties' initial joint status report 29, defendant's motion to stay discovery 28, and defendant's motion to dismiss 27, and orders as follows. Plaintiff shall respond to defendant's motion to stay 28 by 7/24/24. No reply unless ordered by the Court. With respect to defendant's motion to dismiss 27, as is explained in the Court's standing order on motions to dismiss (available on the Court's website), the parties are advised that plaintiff (as the non-moving party) has a right to amend the complaint once within 21 days of the filing of defendant's motion to dismiss under Federal Rule of Civil Procedure 15(a)(1)(B). Accordingly, plaintiff is directed to review defendant's motion to dismiss and to consider exercising its right to amend the complaint as a matter of course under Rule 15(a)(1)(B). If plaintiff decides to amend its pleading in response to the motion to dismiss, it shall file the amended complaint by 8/1/24 and defendant shall file either an answer or a renewed motion to dismiss by 8/22/24. If plaintiff elects not to amend the complaint, but instead chooses to respond to defendant's motion to dismiss, its shall file a response to defendant's motion to dismiss by 8/9/24, and defendant shall file a reply by 8/23/24. The Court will review the parties' submissions and will either issue a ruling by mail or set a hearing if appropriate.
