Accordingly, plaintiff is directed to review defendant's motion to dismiss and to consider exercising its right to amend the complaint as a matter of course under Rule 15(a)(1)(B). If plaintiff decides to amend its pleading in response to the motion to dismiss, it shall file the amended complaint by 8/1/24 and defendant shall file either an answer or a renewed motion to dismiss by 8/22/24. If plaintiff elects not to amend the complaint, but instead chooses to respond to defendant's motion to dismiss, its shall file a response to defendant's motion to dismiss by 8/9/24, and defendant shall file a reply by 8/23/24.
