CLERKS JUDGMENT. IT IS SO ORDERED AND ADJUDGED that Judgment is entered in favor of Plaintiff on Plaintiffs Claim 1 (ECF No. 1), declaring the patent in suit, U.S. Patent No. 8,419,505, invalid as obvious under 35 U.S.C. § 103(a), pursuant to the Courts ruling on Summary Judgment. The Court therefore dismisses as moot Plaintiffs Claim II and Defendants First Counterclaim, because without a valid patent there can be no infringement. Judgment is entered in favor of Defendant on Plaintiffs First and Second Counter Counterclaims regarding false advertising under the Lanham Act 15 U.S.C. §1125(a) and California Unfair Competition Law, California Business and Professions Code §§ 17200 et seq., pursuant to the Courts ruling on Summary Judgment.
