ORDER. The court thanks the parties for their notice that they have settled and that this action may be dismissed. However, because it is not signed by Defendant (as Federal Rule of Civil Procedure 41(a)(1)(A)(ii) requires), it is not self-executing. Accordingly, the court construes the notice as a motion to dismiss pursuant to Rule 41(a)(2), and hereby grants that motion. This action hereby is dismissed with prejudice, with each party to bear their own attorneys' fees and costs. All pending motions, see ECF Nos. [42] , [44] , and [46] , hereby are denied as moot.
