MINUTE entry before the Honorable Steven C. Seeger: The Joint Motion for Voluntary Dismissal Without Prejudice (Dckt. No. 44 ) is hereby granted. Based on the motion, the 661 Patent was formally assigned to Defendant Bodyshop Booster after, not before, the filing of this suit, which calls into question this Courts subject matter jurisdiction. Plaintiff later filed a new case (20-cv-3914) after the assignment of the 661 Patent to Defendant. The parties now request the dismissal of this case (19-cv-6649) without prejudice in light of the limits on this Courts subject matter jurisdiction. Civil case terminated. Mailed notice. MINUTE entry before the Honorable Steven C. Seeger: The parties submitted yet another Stipulation and Proposed Order (Dckt. No. 42 ) about the upcoming schedule. That Stipulation is the third proposed modification to the schedule that the parties have submitted in a little more than two weeks. The first stipulation appeared on June 29 (Dckt. No. 37 ), the second arrived on July 2 (Dckt. No. 38 ), and the third made its appearance on July 13 (Dckt. No. 42 ). The piecemeal proposals have required this Court to divert its attention to the case calendar three times in the past three weeks, requiring three separate minute orders. That is no way to run a railroad (let alone a federal court docket with more than 350 cases). Going forward, the parties shall not make piecemeal scheduling proposals. If the parties foresee scheduling issues, look ahead and plan accordingly. Also, a "Stipulation and Proposed Order" sits uncomfortably with the Federal Rules. Changing the schedule requires an order, see Fed. R. Civ. P. 16(b), and Rule 7(b)(1) provides that a "request for a court order must be made by motion." See Fed. R. Civ. P. 7(b)(1). The need for a motion is not a mere technicality. The Courts internal system treats motions differently than other filings, so a failure to follow the Rules creates a risk that a request for Court action could fall through the cracks. Going forward, the parties shall file a motion if they want to ask for an order. The Court adopts a piecemeal proposal for the last time. The deadline for Defendant Bodyshop Booster to serve its Initial Infringement Contentions is extended from July 13 to July 20. The deadline for Plaintiff CCC Information to serve its Initial Non-Infringement, Unenforceability Contentions is extended from July 27 to August 3, 2020. Mailed notice. (jjr, ) (Entered: 07/14/2020)
