ORDER DISMISSING PLAINTIFF'S CLAIM FOR PATENT INFRINGEMENT by Judge Fernando L. Aenlle-Rocha: On August 1, 2024, the court entered default judgment against Defendants Superspeed LLC, Li Zhou, Fangzhen Tang d/b/a Kipika, andDongguanshihaojuwujiajuyouxian-gongsi dba Seleware as to Plaintiff Savvier Fitness LLC's cause of action for unfair competition. Dkt. [29] at 89. The court denied Plaintiff's request for default judgment as to Plaintiffs only other claim for patent infringement, but granted Plaintiff 21 days' leave to file an amended complaint or a renewed application for default judgment. Id.The court warned that "[f]ailure to file an amended complaint or a renewedapplication may result in dismissal of Plaintiff's patent claim without further notice." Id. at 9. Plaintiff never filed an amended complaint or renewed application for default judgment. Accordingly, the court DISMISSES Plaintiff's claim for patent infringement. See id.; Dkt. 1; Fed. R. Civ.
