MINUTE entry before the Honorable Sunil R. Harjani: Status hearing set for 9/7/2023 is stricken and reset to 12/14/2023 at 9:15 a.m. by telephone. By 9/7/2023 the parties should file a Joint Status Report with an update on the case. The Court has reviewed the latest Joint Status Report 294 . Written discovery is nearing completion and deposition discovery is ongoing. The parties are still working to confirm deposition dates for fact witnesses, third-parties, and a Rule 30(b)(6) deposition. Given the upcoming deadline, the parties need to work with more urgency to get fact discovery done. The Court will extend the fact discovery deadline until 10/31/23 given the number of outstanding depositions identified in the status report and the pending discovery motions before the Court. However, because the case has been pending and the parties have been conducting discovery since November 2021, the parties shall proceed to expert discovery with all deadlines to remain the same. Once there is a ruling on the pending motion to dismiss, the Court will entertain motions to reopen fact discovery for the limited purpose of discovery only into any new affirmative defenses. All other fact discovery shall be completed by 10/31/23. The parties are urged to compromise and reach agreement on outstanding disputes in order to avoid further motion practice that will unnecessarily delay the case and result in additional costs to the parties.
