Description
01/23/25
MINUTE entry before the Honorable Georgia N Alexakis: Motion hearing held on 1/23/25. No one appeared. Defendant Doe 94 (Yam Idf) has not responded to Plaintiff's motion for entry of default and default judgment. Accordingly, the motion [92] is granted. Defendant Doe 94 (Yam Idf) has failed either to plead or to otherwise appear to defend against this action. Based on the evidence previously submitted by Plaintiff and the admission of liability by virtue of the default, Plaintiff has established that a permanent injunction should be entered. The infringement of Plaintiff's intellectual property irreparably harms Plaintiff and confuses the public. Because this infringement was willful and considering the value of Plaintiff's brand as well as the need to deter infringement that is easily committed and difficult to stop, the Court concludes that $31,771.80 is an appropriate award of statutory damages against Defendant Doe 94 (Yam Idf). Plaintiff is directed to submit a modified proposed final judgment order to this Court's proposed order inbox on or before 1/24/25. The proposed final judgment order should be modified to reflect that it is only being entered with respect to Defendant Doe 94 (Yam Idf), not any other defendant who is the subject of the final judgment order at [76] .
