The Court having reviewed the Plaintiffs' response to the Court's Order directing the filing of certain documents/supplemental information, provides Notice that at the hearing in this matter set for July 26, 2023, the Court will inquire of counsel for the Plaintiff on each of the following topics: (1) the reason that portions of the propounded Requests for Admission were filed as directed but in a redacted format without leave of Court as to redaction; (2) to what Plaintiffs are referring when they state "Plaintiffs acknowledge the Court's note concerning the damages and lost profits figures for each of the allegedly infringing products", which appears to be non-responsive to the inquiry in the Court's prior Order; (3) whether, and if so how, the Court should consider the analysis and principles set out in Electrical Workers Local 369 Benefit Fund v. Churchman Electric & Technologies, LLC, No. 3:19-cv-652-DJH-CHL, 2022 WL 989732, *4 (W.D. Ky. Jan. 19, 2022), adopted by 2022 WL 2405366 (W.D. Ky. ORDER. Having reviewed the materials filed in support of the Motions for Default Judgment and Permanent Injunction in this case and related cases, the Court ORDERS as follows: (1) no later than 2 pm on July 25, 2023, Plaintiffs shall file a certification that, to the best of Plaintiffs' knowledge, none of the defendants named in Schedule A [ECF No. 75 -1, at 11-12] have previously been named as Defendants in any case asserting infringement of the same patent in other cases filed in this Court; (2) no later than 2 pm on July 25, 2023, Plaintiffs shall file on the docket the full text of all of the requests for admission referenced in the Declaration of Brian Malkin [ECF No. 75 -2]; (3) the Court advises Plaintiffs that, at the hearing scheduled for July 26, 2023, Plaintiff shall be prepared to explain the good faith basis underlying the damages and lost profits figures (including the profit figures for each of the allegedly infringing products and the market selling price of each of such products) propounded in the requests for admission.
