MINUTE entry before the Honorable Andrea R. Wood: The parties' joint motion to amend case schedule 52 is granted. The case schedule is amended as follows: Plaintiff shall serve final infringement contentions by 3/2/2023. Defendant shall serve final unenforceability and invalidity contentions and document productions by 3/2/2023. The parties shall exchange proposed claim terms to be construed and proposed constructions by 3/16/2023. Defendant's final non-infringement contentions shall be made by 3/30/2023. Plaintiff's final enforceability and validity contentions shall be made by 3/30/2023. Defendant's opening claim construction brief shall be filed by 4/20/2023. The parties' joint appendix pursuant to LPR 4.2(b) shall be filed by 4/20/2023. Plaintiff's responsive claim construction brief shall be filed by 5/17/2023. Defendant's reply claim construction brief shall be filed by 6/3/2023. The parties' joint claim construction chart and status report shall be filed by 6/10/2023. The parties shall proceed with the filing of their joint status report on 1/9/2023. ANNUAL REMINDER: Pursuant to Local Rule 3.2 (Notification of Affiliates), any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. MINUTE entry before the Honorable Andrea R. Wood: The Court has reviewed the parties' joint status report 49 and the magistrate judge's most recent minute order 50 . The parties report that they believe they will be able to meet the amended case schedule set on 8/1/2022 47 . However, the parties also note that Defendant Xolution, GmbH still has pending insolvency proceedings in Germany that may necessitate a request for a stay or a motion for leave to amend the pleadings. Accordingly, by 1/9/2023, the parties shall file an updated joint status report setting forth: (1) confirmation that the parties are on track with the schedule set on 8/1/2022; (2) if no motion for a stay or for leave to amend the pleadings has been filed, whether the parties expect such motions to be filed and, if so, when; (3) any change in the parties' views regarding the possibility of settlement; and (4) any other matters that the parties would like to discuss with the Court at a telephonic status hearing.
