Harjani: Defendant's motion to stay discovery 32 during the pendency of the motion to dismiss is granted in part and denied in part. This Court has significant discretion to manage discovery to ensure that it is just, speedy and inexpensive pursuant to Fed. R. Civ. P. 1, 16 and 26. In this patent infringement case, discovery will be voluminous, time-consuming, and expensive and thus it makes sense for a dispositive motion to be resolved prior to commencing this journey. In addition, the ruling on the motion to dismiss may narrow the claims and focus the issues, which could help make discovery more cost-effective that it would be now. This case was also recently filed in October 2022, Plaintiff chose to file a First Amended Complaint rather than stand on its original complaint, and the motion to dismiss that complaint was recently filed on 1/6/23 and is not yet fully briefed. Thus, there has not been any significant delay in this case that warrants rushing into full-blown discovery at this time. However, to ensure that the matter moves along while the motion to dismiss is being briefed and considered, the Court will allow the parties to conduct their Rule 26(a)(1) disclosures and serve interrogatories that they wish to issue. This process will allow the case to move forward but will not impose an undue burden on the parties, as the discovery burdens with these tools are relatively minor when compared to document requests and depositions. No other discovery may be served at this time. The Court will revisit the discovery schedule once the motion to dismiss has been ruled upon.
