MINUTE entry before the Honorable Iain D. Johnston: Before the Court is the parties joint motion for a stipulated judgment and consent decree 72 . The Court appreciates the efforts the parties put into reaching their agreement to settle. But upon reviewing the language of the proposed order, the Court is concerned about its ability to retain jurisdiction to enforce any terms that are not incorporated into the consent decree, and are instead found only in a confidential settlement agreement that is not in the record. See, e.g., Blue Cross & Blue Shield Assn v. Am. Express Co., 467 F.3d 634 (7th Cir. 2006). The Court will discuss this concern with the parties during a telephonic status hearing, which will be governed by Fed. R. Evid. 408 to facilitate discussion of any confidential terms of the parties agreement.
