01/16/25 | ORAL ORDER: Having reviewed Defendants' pending summary judgment motion (D.I. 405) and the accompanying briefing (see D.I. 408; D.I. 421; D.I. 438), the Court requires additional briefing regarding Plaintiffs' constitutional standing to pursue lost profit damages. See TransUnion LLC v. Ramirez, 594 U.S. 413, 430-31 (2021); Intell. Tech LLC v. Zebra Techs. Corp., 101 F.4th 807, 814 (Fed. Cir. 2024). IT IS HEREBY ORDERED that, by no later than 5:00 pm ET on January 21, 2025, Plaintiffs shall file with the Court a letter brief, not to exceed three (3) pages, addressing, with respect to each asserted patent and at the pertinent time(s) for assessing constitutional standing, see Lutter v. JNESO, 86 F.4th 111, 123-26 (3d Cir. 2023); Alps S., LLC v. Ohio Willow Wood Co., 787 F.3d 1379, 1384-85 (Fed. Cir. 2015) the following: (1) whether Plaintiff Chervon (HK) Limited possessed constitutional standing to pursue its own lost profits; (2) whether Plaintiff Chervon (HK) Limited possessed constitutional standing to pursue the lost profits of Plaintiff Chervon North America, Inc.; (3) whether Plaintiff Chervon North America, Inc. possessed constitutional standing to pursue its own lost profits; and (4) whether Plaintiff Chervon North America, Inc. possessed constitutional standing to pursue the lost profits of Plaintiff Chervon (HK) Limited. See Spine Sols., Inc. v. Medtronic Sofamor Danek USA, Inc., 620 F.3d 1305, 1319 (Fed. Cir. 2010), abrogated on other grounds by Halo Elecs., Inc. v. Pulse Elecs., Inc., 579 U.S. 93 (2016).
