Having reviewed Plaintiff's [45] Response to the Motion ("Response"), Defendant's [47] Reply Brief in Support of the Motion, the applicable law, and the arguments of the parties at the hearing, the Motion is GRANTED for the reasons set forth on the record at the hearing.
