NY )	TEXT ORDER Setting Briefing Schedule for Claim Construction Proceedings: Because plaintiff's motion for summary judgment has now been resolved, the deadlines as to the parties' claim construction briefs (Dkt Nos. 39 and 40 ) are no longer stayed. It is hereby ORDERED that the parties shall file their responsive claim construction briefs by 4/18/2023. As part of their responsive claim construction briefs, the parties shall include a section addressing any additional disputed claim constructions that arose in the course of briefing 41 plaintiff's motion for summary judgment, most notably the term "one selected from Ga and Al." The combined response and supplemental section shall not exceed 25 pages. The parties shall then file any responsive brief related to the supplemental issues only by 5/2/2023, in briefs not to exceed 15 pages. A Markman Hearing will be held on 5/9/2023 at 10:00 AM in Syracuse, NY before Magistrate Judge David E. Peebles to address all of the disputed claim construction issues. NY )	DECISION AND ORDER that that the parties' agreed construction of the order of the steps recited in the claimed method of Claim 2 as outlined in their joint claim construction statement is adopted, and the claim term is construed to mean "method Claim 2 requires performance of the steps in the sequence recited in the claim, namely, step (a) is performed, and then step (b) is performed, and then step (c) is performed." Plaintiff's motion for summary judgment (Dkt. No. 41 ) is GRANTED in part (specifically, with regard to Claim 2 of the 270 Patent), and DENIED in part (specifically, with regard to Claim 9 of the 270 Patent) without prejudice to renewal following claim construction proceedings related to Claim 9. The parties shall supplement their opening claim construction briefs to include thorough arguments regarding any disputed claim terms that arose in the course of litigating the motion for summary judgment that were not included in their opening claim.
