ENDORSED ORDER: The parties' "Joint Motion for Entry of Stipulated Final Judgment and Permanent Injunction and Joint Stipulation of Dismissal" (Doc. # 198) is denied. While the Court appreciates that the parties have negotiated a settlement, this Court does not retain jurisdiction to enforce settlement agreements between private parties, including stipulated judgments and permanent injunctions entered into as part of an agreement. This is because the failure to perform under a settlement agreement should be addressed in a separate breach of contract action. And, once a case is dismissed, this Court will no longer entertain the parties' requests for relief in that case. To the extent the parties wish to have the proposed permanent injunction entered on the docket in this case so the parties may initiate a new and separate lawsuit if it is violated, then such permanent injunction is acceptable to the Court. Thus, the parties may file an amended proposed stipulated final judgment and permanent injunction on the docket that clearly states in its terms that no enforcement of the settlement agreement or the permanent injunction will take place in this case. If this is unacceptable to the parties, then they may continue to litigate this action on the merits or negotiate a settlement that does not involve entry of a stipulated permanent injunction. ENDORSED ORDER: On the basis of the parties' joint Notice of Settlement (Doc. # 195), this cause is hereby dismissed, without prejudice and subject to the right of the parties, within 60 days of the date hereof, to submit a stipulated form of final order or judgment, or request an extension of time, should they so choose or for any party to move to reopen the action, upon good cause being shown. After that 60 day period, however, without further order, this dismissal shall be deemed with prejudice. Furthermore, the Court advises the parties that "good cause" exists to reopen an action when a settlement agreement has yet to be finalized because of various delays. But incomplete performance of an executed settlement agreement, such as the failure to disburse settlement funds, does not constitute good cause to reopen an action. This Court does not retain jurisdiction to ensure performance of a settlement agreement because such failure to perform should be addressed in a separate breach of contract action.
