In the Parties` 10/15/2021 40 Joint Status Report, Plaintiff indicated that "Plaintiff is continuing to work on preparing a new video of the EMO and, subject to approval from the Court, has consent from Defendant to submit this video next week." In its 10/18/2021 40 Scheduling Order, this Court stated that "Plaintiff shall, contemporaneously with the submission of the proposed video to Chambers, file a report on ECF" addressing certain points raised by the Court. See ECF No. 40 (detailing the points for Plaintiff to address). Plaintiff did not file a video during the week of 10/18/2021-10/22/2021. As such, this Court HEREBY ORDERS Plaintiff to file a status report no later than close of business on 10/26/2021 as to why the video and the accompanying report has not yet been filed. In reviewing the parties` briefing with respect to Defendant`s 29 Motion to Dismiss, the Court finds that further information on certain issues may aid the Court in its decision-making. The parties are ORDERED to meet and confer on the following issues and provide a joint status report on or before 10/15/2021 addressing : (1) whether EMO is currently available for purchase and being distributed anywhere, and (2) whether a live demonstration of the VECTOR, COZMO, and EMO robots for the Court is feasible, and, if so, whether such demonstration would be appropriate for the Court to consider as part of an analysis of substantial similarity. The parties are FURTHER ORDERED to, on or before 10/15/2021, (i) provide the Court with a video of the EMO robot (as opposed to a hyperlink to a website) for the tables referenced in paras. 47, 50, 61 of the 27 Second Amended Complaint and (ii) indicate and explain changes, if any, to the time referenced in such tables.
