Martinez, Chief United States District Judge: On April 29, 2021, Defendants filed the above Motion to Dismiss. The Court granted a stipulated Motion to Stay this case pending a related appeal. Dkt. #37. The parties have updated the Court to say that the appellate court affirmed the underlying Nevada district court ruling. Dkt. #42. Plaintiff is still evaluating its options on appeal and the parties indicate they will update the Court again on or before September 2, 2022. Given the passage of time and the appellate ruling, the factual and legal background for this motion have likely changed. The parties appear to be in no hurry to get a ruling on this Motion.
