MINUTE entry before the Honorable Thomas M. Durkin: The Court addresses the objections raised by Kenall in R. 687. Per the Court's ruling on 4/4/24, the Court allowed Cooper to revise the Ricca and Conroy reports. R. 679. This ruling was based on the Court's prior opinion that Cooper could update the Ricca and Conroy reports only if it was possible to remove the assertion that modularity is "is not present in the [Subject Single Products]." R. 674 at 28. The Court clarifies that it did not give Cooper leave to supplement the reports with new or additional material. Rather, the Court allowed Cooper to revise the reports to remove the assertion and to also remove "any opinion that incorporates or is based on this assertion." Id. Additionally, the Court did not provide Cooper with leave to revise the Lewis report. As the Court stated: "[T]he parties [may] supplement their expert's materials-considered lists with more specific disclosures. This should not be a difficult task." R. 674 at 27. Cooper may not submit a revised report from Lewis and may submit only a supplemental materials-considered list. This list is limited to materials that Lewis considered at the time he wrote the original report. Because Cooper is not entitled to submit a revised report for Lewis, Kenall's request for an additional deposition of Lewis is denied. Cooper should submit a supplemental materials-considered list for Lewis by May 3, 2024 and should revise the Ricca and Conroy reports by May 3, 2024, ensuring that the reports conform with the above clarifications. Kenall may take depositions of Ricca and Conroy lasting no longer than one hour to address these revisions. Those depositions should be completed by May 24, 2024. The parties should attempt to resolve future issues through meeting and conferring. To the extent the parties are unable to resolve additional Daubert issues through meeting and conferring, they should submit a joint status report to the Court that 1) lists their attempts to meet and confer and 2) sets forth their respective positions.
