05/30/24 | PAPERLESS ORDER granting 109 Defendant's Motion for Leave to File its opposition brief. On May 2, 2024, Plaintiff moved to supplement its pending Motion for attorneys' fees with the fees it incurred in appealing this matter. (DE 104 ). The certificate of conferral represented that Defendant did not object to Plaintiff's ability to supplement its Motion, but that Defendant objected to the merits of Plaintiff's entitlement to fees and the fee amount. Accordingly, I entered a paperless order (DE 106 ) and informed the Parties that I would consider Plaintiff's supplemental material but allowed Defendant the standard two-week period, or until May 17, 2024, to file a response in opposition to the amount that Plaintiff represented it had incurred on appeal. Defendant failed to timely file a response. Now, Defendant seeks to file its response brief (DE [109-1]) to Plaintiff's supplemental information. I note that Defendant wholly fails to provide any explanation whatsoever as to why it failed to submit a response by the Court-ordered deadline. This is unacceptable. Nevertheless, because the relief is unopposed by Plaintiff, and because I believe any forthcoming order ruling on the merits of Plaintiff's Motion for attorneys' fees can only benefit from full briefing as to all incurred fees and costs, I will grant Defendant's Motion. Defendant has until May 31, 2024, to separately file its attached brief in opposition to Plaintiff's supplement.
