05/02/24 | MINUTE ORDER (TEXT Only): On May 1, 2024, the Court convened a status conference to address potential resolution of this matter and the related matter, Deerpoint Group, Inc. v. GAR Bennett LLC (1:23-cv-1340-JLT-BAM). Counsel for Defendants Agrigenix, LLC and Sean Mahoney and counsel for Plaintiff stated that the parties had not agreed to a mediator's proposal and the case did not settle. Counsel for Plaintiff and counsel for Defendant GAR Bennett LLC informed the Court that the parties in that matter were still in the process of selecting a mediator. The Court noted that there was not a motion for default judgment as to the defaulted Defendant Agrigenix. Counsel for Defendants noted that the motions for summary judgment addressed the remaining insured claim, but was uncertain about whether entry of judgment and potential proving up regarding Defendant Agrigenix was possible. Counsel for Plaintiff stated that the claims against Defendant Agrigenix would not be affected by the cross motions for summary judgment. Counsel for Defendants Agrigenix, LLC and Sean Mahoney and Counsel for Plaintiff stated that the parties had agreed to a two-day mediation in this matter to attempt to resolve this matter and the Scottsdale Insurance Company v. Agrigenix et al. (1:23-cv-1548-JLT-EPG) matter. Counsel for Scottsdale Insurance Company informed the Court that the mediation dates had been confirmed for April 16 and April 17, 2024. Counsel for Scottsdale Insurance Company further informed the Court that the Scottsdale Insurance Company v. Agrigenix et al. matter was set for a scheduling conference on February 20, 2024, but any dates scheduled there would likely not impede the contemplated resolution of these matters.
