MINUTE entry before the Honorable John F. Kness: Before the Court is Plaintiffs' Motion for Entry of Default and Default Judgment 22 . All remaining Defendants have failed either to plead or to otherwise appear to defend against this action. Accordingly, default is entered under Rule 55(a) of the Federal Rules of Civil Procedure. Moreover, no remaining Defendant against whom default judgment is sought has appeared personally or by a representative. Written notice of Plaintiffs' motion for default judgment, therefore, is not required, see Fed. R. Civ. P. 55(b)(2). As to Plaintiffs' request for entry of a default judgment, further clarification is necessary. Plaintiffs filed this action alleging patent infringement. (Dkt. 1.) Plaintiffs ask this Court to enter default and grant default judgment against Defendants under Rule 55 of the Federal Rules of Civil Procedure. (Dkts. 22; 23.) Plaintiffs also request a permanent injunction against Defendants as well as various damages amounts. (Dkt. 23 at 811.) Specifically, Plaintiffs request compensatory damages under 38 U.S.C. § 284 in the amount of $50,000 per defaulting Defendant. (Id. at 910.) Plaintiffs suggest that this damages request is based on the "length of use, consumer confusion, lost sales, loss of reputation, loss of market, and profit made by Defaulting Defendants" but provide no additional evidence supporting their request for compensatory damages of $50,000 per Defendant. (Id. at 10.) Plaintiffs also seek enhanced damages under 35 U.S.C. § 284 and reasonable attorneys' fees under 35 U.S.C. § 285c, but Plaintiffs do not specify the amount of enhanced damages they seek. (Id. at 911.) Accordingly, an in-person motion hearing is set for 4/12/2024 at 9:00 A.M.
