MINUTES (IN CHAMBERS) ORDER GRANTING Defendant's Ex Parte Application [21] , STRIKING Plaintiff's Request for Default [20] , and DISCHARGING Order to Show Cause [19] by Judge Fred W. Slaughter: the court GRANTS Defendants Application, (Dkt. [21] ), and DENIES Plaintiffs Request for Entry of Default, (Dkt. [20] ). As discussed above, the court is cognizant that Plaintiff filed the request for entry of default in response to the court's 10/31/2024, Order to Show Cause. In light of the pending Motion to Amend the Complaint, the court finds Plaintiff continues to actively prosecute this action and thus DISCHARGES the 10/31/2024, Order to Show Cause. Additionally, because Defendant has yet to file a responsive pleading to the Complaint, the court ORDERS Defendant to file a responsive pleading by 11/11/2024. notes that Defendant's opposing brief to the Motion to Amend the Complaint is due by 11/14/2024; and Plaintiff's reply brief is due by 11/21/2024.
