Defendant The Glass Door Company, Inc., d/b/a Doors 22, applies ex parte for an order authorizing it to amend its papers opposing a motion for preliminary injunction filed by Plaintiff The Sliding Door Company. Defendant submits that counsel determined in discovery that some representations made in its brief were not true, and amendments are intended to correct attendant errors.Plaintiff opposes the application. The application is DENIED for failure to justify relief on an ex parte basis. Defendant fails to show how its case would be irreparably harmed if the Court does not authorize the papers to be corrected on an emergency basis (SEE DOCUMENT FOR SPECIFICS). However, counsel have wasted their clients'and the Court'stime andresources ventilating an unnecessary ex parte application, so the Court OFFERS THE FOLLOWING DIRECTION. Defendant forthwith shall file the amended documents and redlines attached as Exhibits 25 to the declaration of James Doroshow separately on the docket as amended opposition papers. Plaintiff may file amended reply papers WITHIN SEVEN DAYS. The Court will consider the amended papers to resolve the motion. Unless the Court orders otherwise, the motion will STAND SUBMITTED without a hearing 53 .
