In discussions with counsel regarding scheduling, the Court was referred to the Joint Status Report of 5/31/24 - which was presented before the District Judge [dkt. 338 ], in which a proposed schedule for completion of discovery was included. Although LKQ was seeking to have further discovery stayed pending certain decisions by the District Court and the Court of Appeals, after considering the positions of counsel, I have concluded that expert discovery should proceed in accordance with the following schedule submitted in the Joint Status report. Fact discovery related to privilege waiver (if any) is to be completed by 8/16/24. In other respects, fact discovery is already closed. The following schedule shall govern expert discovery: Deadline for a party to determine if it will rely on an advice of counsel defense to a charge of willful infringement, and if so, to produce any discovery previously withheld as privileged that is related to any such defense by 7/16/24; LKQ shall provide amended final invalidity contentions, but absent leave of court, such contentions shall be limited to addressing the new obviousness standard articulated by the Federal Circuit, and shall not introduce new prior art references, combinations, or invalidity theories unrelated to obviousness (e.g., unenforceability, anticipation, or 112 defenses) by 7/25/24; Deadline to complete fact discovery related to privilege waiver (if any) by 8/16/24. GM shall provide final validity contentions, but such contentions shall be limited, absent leave of Court, to responding to any new issues included in LKQ's amended final invalidity contentions by 8/22/24; LKQ's amended/supplemental invalidity expert report(s) and GM's opening damages and willfulness expert report(s) due by 10/1/24; GM's rebuttal report(s) to LKQ's amended/supplemental invalidity expert report(s) and LKQ's rebuttal damages and willfulness expert report(s) due by 11/6/24; Deadline to depose/re-depose experts who submitted amended/supplemental invalidity expert reports and/or rebuttals thereto and Deadline to depose damages and/or willfulness experts by 12/12/24.
