PAPERLESS ORDER. The parties initially appeared before us in the related case, Hyper Ice, Inc., et al., v. Schedule A, 24-cv-21791. There, our Defendant was represented by counsel, Shanshan Liang of Tallahassee. We eventually dismissed without prejudice our current Defendant from that case, see June 11, 2024 Order, and the Plaintiffs filed this standalone suit. Operating under the assumption that our Defendant would still be represented by Ms. Liang, we granted the Plaintiffs' motion for alternate service of process and allowed the Plaintiffs to serve the Defendant "via electronic email on the Defendant's counsel (namely, Liang + Mooney, PLLC)." See 7 Omnibus Order at 7. The Plaintiffs complied, see 12 Proof of Service, but no defense counsel has yet appeared on the docket, and Ms. Liang did not acknowledge an email we sent to her (and Plaintiffs' counsel) in advance of the June 21, 2024, preliminary-injunction hearing. Our concern, then, is that Ms. Liang isn't representing the Defendant in this case, and that none of the filings that have been served on her have reached the Defendant. Accordingly, in a separate order, we will direct the Plaintiffs to serve the 1 Complaint, the 9 Summons, and all other docket entries on the Defendant directly. Should the Defendant not respond to the 1 Complaint or otherwise appear within 21 days, we will then order the Plaintiffs to move for Clerk's Entry of Default. Signed by Judge Roy K.
