07/07/21 | PAPERLESS ORDER. THIS CAUSE came before the Court upon a sua sponte examination of the record. On January 28, 2020, the Court entered its Paperless Order of Referral to Mediation. 72 . The Parties conducted mediation on September 23, 2020. 101 . The case did not settle at that time, however the Interim Report of Mediator stated that "[p]rogress towards settlement was made during the mediation session and the Parties' principals agreed to continue discussions themselves later that week," and "the mediation was continued with the consent of the [P]arties." See id. Based on the Parties assertions that mediation was "productive, and prompted follow up settlement negotiations between the principals of the Parties," the Court granted the Parties' motion for an extension of the discovery and pretrial motions deadlines. See 99 ; 100 . Thereafter, the Parties filed their respective pretrial motions, two of which remain pending. See 132, 134 ; 136 . Given the procedural posture of this case, the complexity of the issues involved, and the Parties' previous progress in mediation, the Court finds that further mediation is appropriate. Accordingly, it is ORDERED AND ADJUDGED that, pursuant to Local Rule 16.2 of the United States District Court for the Southern District of Florida, the Parties SHALL continue mediation within 180 days of this Order. Within five (5) days following the mediation conference, the mediator shall file a Mediation Report indicating whether all required parties were present. The report shall also indicate whether the case settled in full or in part, was continued with the consent of the Parties, or whether the mediator declared an impasse. To the extent the Parties reach settlement in part, the Parties shall provide the Court with a joint status update as to the issues that remain in dispute within thirty (30) after the mediation conference. The Parties shall agree upon a place, date, and time for mediation convenient to the mediator, counsel of record, and unrepresented parties (if any) and file a Notice of Scheduling Mediation within 120 days of this Order.
