ORDER DEFERRING ruling on the Motion for Attorney Fees 49 until after resolution of the pending appeal and directing the Clerk to administratively terminate said motion. Defendant may file a motion to renew its attorney's fees motion at the conclusion of the appeal/issuance of the mandate. Plaintiffs' Motion to Set Aside said motion 65 is DENIED as there is no procedure under the federal rules for setting aside a motion. Lastly, now that this case is on appeal, the Court concludes that it is without jurisdiction to rule on the pro se Motion to Dismiss 71 and DIRECTS the Clerk to terminate said Motion.
