In the Courts experience, discovery disputes often may be resolved without the need for formal motion papers. To facilitate the just and expedient resolution of discovery matters and to conserve the Courts and the parties resources, the Court requires the parties to follow the procedure below for filing discovery motions. MINUTES (IN CHAMBERS) ORDER GRANTING IN PART AND DENYING IN PART MOTIONS TO STRIKE by Judge Andre Birotte Jr.: Case Nos. 2:21-cv-05876-AB-PDx and 2:21-cv-05300-AB-PDx are two sides of the same coin in a patent infringement dispute: NICOR, Inc. v. SourceBlue, LLC, 2:21-cv-05876-AB-KS is a patent infringement suit regarding the `427 patent that was first filed in the District of Delaware; Infinilux Corporation v. NICOR, Inc., 2:21-cv-05300-AB-PD was filed in response, and seeks declaratory relief of invalidity and noninfringement of the `427 patent. Before the Court are Sourceblue`s and Infinilux`s 20 ("Movants") motions to strike the same affirmative defenses asserted by NICOR. The Motions are GRANTED in part and DENIED in part. The Court GRANTS the Motion in part, and STRIKES the phrase "including but not limited to" from NICOR`s Fourth Affirmative Defense. The Motions are otherwise DENIED. As reflected by the duplicative Motions, it is inefficient to litigate this patent infringement dispute as two separate but related cases. Rather, it appears to the Court that these cases should be consolidated for all purposes pursuant to Fed. R. Civ. P. 42. The Court ORDERS the parties to meet and confer on consolidating these cases, with the expectation that they will stipulate to doing so and agree which case should be the lead case. The parties must file a Stipulation and Proposed Order by 12/23/2021, or if they cannot agree, a Joint Report stating their positions. Court Reporter: N/A. (gk) (Entered: 12/16/2021)
