DEFAULT JUDGMENT: ORDERED AND ADJUDGED that Plaintiff BTL's motion for a default judgment is granted; that Plaintiff BTL is awarded a default judgment in the total amount $369,175.50 against Defendant Infinite Beauty Esthetics LLC; that Defendant Infinite Beauty Esthetics LLC and all those acting in concert of participation with Defendant Infinite Beauty Esthetics LLC are permanently enjoined from: A.Using BTL's trademarks, or any reproductions, copies, or colorable imitations thereof, in any manner in connection with the promotion, marketing, advertising, offering for sale, or any good or service that is not a good or service offered by a genuine BTL product, or is not authorized by BTL to be offer in connection with BTL trademarks;B.Passing off, inducing, or enabling others to sell or pass off any good or service as a good or service offered by a genuine BTL product, or any other good or service offered by BLT, that is not BTL's or not offered under the authorization, control, or supervision of BTL and approved by BTL for sale;C.Committing any acts calculated to cause consumers to believe that Infinity Beautys goods or services are those sold under the authorization, control, or supervision of BTL, or are sponsored by, approved by, or otherwise connected with BTL;D.Using, making, selling, offering for sale, or importing into the United States any counterfeit EMSCULPT NEO devices; andE.Reproducing, distributing, or copying any of BTL's copyrighted works or derivatives of BTLs copyrighted works;and that this case is closed.Ordered by Clerk of Court on 8/9/2023. ORDER granting 14 Motion for Default Judgment against Infinite Beauty Esthetics LLC. For the foregoing reasons, the undersigned GRANTS Plaintiff's Motion for Default Judgment, and ORDERS that the clerk enter a judgment consistent with this opinion. The Court has ordered the permanent injunctive relief set forth above. Plaintiff is also awarded a total of $369,175.50, which consists of: (1) $113,000 in actual damages; (2) $226,000 as a result of treble damages on the Lanham Act claim; (3) $30,000 for the copyright claim; and (4) $175.50 in costs.
