DE )	ORAL ORDER: The Court has reviewed Defendant’s motion for leave to file an amended Answer to Plaintiff’s First Amended Complaint (“FAC”). (D.I. [149] (“motion to amend the Answer to the FAC”)) It has also reviewed the parties’ recent letters regarding the currently-scheduled October 15 hearing on the motion to amend the Answer to the FAC, as well as regarding events that have occurred subsequent to the scheduling of that October 15 hearing, including: (1) Plaintiff’s filing of a Second Amended Complaint (“SAC”), (D.I. [169] ); (2) Defendant’s filing of an Answer to the SAC, (D.I. [174] ); and (3) Plaintiff’s filing of a motion to strike portions of Defendant’s Answer to the SAC (“motion to strike”), (D.I. [184] ). (D.I. [187] ; D.I. [188] ) In light of these subsequent events, the Court hereby DENIES as MOOT the motion to amend the Answer to the FAC, as that motion sought to amend an Answer that is no longer operative (an Answer to a complaint that is itself no longer operative). The Court thus also ORDERS that the October 15, 2024 hearing is CANCELED. Any ongoing disputes with regard to Defendant’s ability to include certain defenses and counterclaims in its now-operative Answer shall be addressed when the Court resolves Plaintiff’s motion to strike, which has not yet finished briefing.
