ORAL ORDER - As discussed at the end of today's oral argument, the first day of the currently scheduled trial is Yom Kippur. Although the Court discussed starting on Tuesday instead of Monday, due to the Court's schedule, IT IS HEREBY ORDERED that the trial will now start on Wednesday, September 27, 2023 and go into the following week. Should Intuitive not be able to make those dates work, the Court will look to reschedule the trial in 2024. ORAL ORDER - IT IS HEREBY ORDERED that the parties shall engage in in-person mediation in good faith. The parties are to jointly hire an agreed-upon mediator. The timing of mediation efforts is left to the discretion of the parties, but the mediation must be conducted in advance of the pretrial conference. No later than one week before the pretrial conference, the parties shall submit a joint statement that identifies the mediator, the lead counsel for each party at the mediation and the length of the mediation, as well as a certification by the lead counsel that they have engaged in the mediation efforts in good faith. The joint statement should not disclose the substance of any offers, counteroffers or other negotiations. If the parties anticipate any further mediation efforts will be conducted after the deadline to submit the joint statement, the parties shall indicate that in their submission and state when those efforts are expected to occur.
