ORAL ORDER: The Court, having reviewed the parties' joint notice of availability for trial and motion to amend the scheduling order, (D.I. 218), hereby ORDERS as follows: (1) The pretrial conference will be held on March 13, 2026 at 11:00 a.m. Trial will begin on March 23, 2026.; (2) With respect to the parties' dispute regarding whether Plaintiff should be required to move for leave to amend or supplement its infringement contentions, the Court understands why supplemental infringement contentions regarding Defendant's redesigned system would be helpful prior to supplemental expert reports. However, for the reasons set out by Plaintiff, good cause exists for supplementation of its infringement contentions, and thus a motion for leave to file such contentions is not necessary. (D.I. 218 at 3) The Court therefore ADOPTS Defendant's proposed case schedule, with the modification that Plaintiff shall file its supplemental infringement contentions by January 31, 2025.; and (3) By December 27, 2024, the parties shall file a revised proposed scheduling order reflecting these rulings.
