MINUTE entry before the Honorable Sunil R. Harjani: The Court has reviewed the Report of the Parties' Planning Meeting and Estimated Patent Case Schedule 59 . The Local Patent Rules apply to this case. The Court adopts the parties' additional discovery plan proposals as follows: (1) Each party may serve no more than 25 interrogatories and responses to interrogatories served by plaintiff in 2023 are due by 7/8/2024; (2) Each party may serve no more than 25 requests for admissions and responses are due within 30 days of service; and (3) Each party may take no more than 10 depositions, including expert depositions, and no deposition shall exceed seven hours of question time. The parties advise that Initial Disclosures were completed on 6/2/2023, Revised Initial Infringement Contentions were served on June 14, 2024, and Initial Non-Infringement, Unenforceability, and Invalidity Contentions were served on June 30, 2023. Further, the Court sets the following initial case schedule: (1) Initial Response to Non-Infringement, Unenforceability, and Invalidity Contentions due 6/20/2024; (2) Final Infringement, Unenforceability, and Invalidity Contentions due 11/8/2024; (3) Final Non-Infringement, Enforceability, and Validity Contentions due 12/6/2024; and (4) Exchange of Claim Terms Needing Construction and Proposed Construction due 12/20/2024. No claim construction briefs or dispositive motions may be filed until an in-person status conference has been held with the Court. This case is referred to the Magistrate Judge for discovery supervision (including adjusting all deadlines as needed), resolution of discovery motions, and settlement discussions.
