TEXT ORDER: By August 30, 2024, the parties shall conduct the deposition of Defendants' expert Dr. Justin Hanes to inquire solely as to the royalties to which Dr. Hanes is entitled to receive in connection to the patents covering Alcon's competing products discussed at the August 20, 2024 discovery dispute hearing. The deposition shall be limited to one hour and focused only on any royalties Dr. Hanes received from 2021 to present. The Defendants may, but are not required to, provide further information about Dr. Hanes's relationship with Alcon; however, if the Defendants elect to not provide further information, the Court may conclude that there is an ongoing relationship between Alcon and Dr. Hanes for reasons stated on the record at the August 20, 2024 hearing. If Defendants elect to provide further information, such information shall be disclosed to Plaintiffs prior to the deposition so that Plaintiffs may have an opportunity to further inquire about it at the deposition for no more than one additional hour. By September 4, 2024, the parties shall each file a letter not to exceed two (2) pages informing the Court of their respective positions as to Dr. Hanes's relationship with Alcon. Their letters shall include relevant case law supportive of the parties' respective positions. The parties are also ordered to meet & confer to discuss the remaining case schedule with an anticipated trial commence date of February 18, 2024.
