ORDER. The request for a conference or oral argument is denied as unnecessary. Alexsam is to supplement its coverage analysis in light of the claim construction order by 10/11/2024. Without such a statement, Defendant will be uncertain as to the scope of discovery needed.Alexsam is to provide a Final Coverage Analysis identifying with specificity what it alleges is covered by the claims of the patents; Mastercard is to provide Final Invalidity Contentions explaining the bases for its contentions regarding invalidity of the patents-in-suit. The deadline for Alexsam to submit its final coverage analysis is 5/30/2025. The deadline for Mastercard to submit its final invalidity contentions is 6/30/2025.Responses to the previously issued discovery request will be supplemented, as necessary, by 10/31/2024. The parties may proceed with discovery under the Federal Rules of Civil Procedure, without the additional limitations proposed by any party at ECF No. [314] , unless otherwise noted in this Order.Alexsam is permitted to take up to 10 fact depositions of Mastercard witnesses and up to 14 hours of deposition time of Mastercard's corporate representative(s) pursuant to Rule 30(b)(6). Mastercard is permitted to take up to 7 hours of deposition time of Alexsam's principal and only employee, Robert Dorf. As to ediscovery, Mastercard will identify 10 custodians files, which are likely to have relevant and responsive information. In the 10 selected custodian files, Mastercard will search no more than 10 key words and/or phrases to be agreed upon by the Parties. Mastercard will search the custodian files for hits on the key words and/or phrases during the time period of at least May 2009 through July 10, 2017.A joint status report is due to the Court on 3/14/2025.Fact discovery closes 4/30/2025. The exchange of opening expert reports by the party with the burden of proof is due 8/15/2025. The exchange of rebuttal reports in response to opening expert reports is due 10/3/2025. Expert discovery closes 11/7/2025. Parties are to submit a joint letter confirming that discovery has concluded on or before 11/12/2025. Parties are to request a premotion conference on all dispositive motions on or before 12/2/2025.In light of the age of the case and discovery already conducted, the parties should not expect this schedule to be amended absent good cause.
