TEXT ORDER - This matter came before the court January 17, 2024, on defendants' motion to continue hearing on claim construction in light of ongoing settlement negotiations DE [109] and for conference in furtherance of management of this and the related case, (5:23-cv-297), in accordance with Federal Rule of Civil Procedure 16(a). Based upon representations made on the record, the motion is GRANTED. Claim construction hearing in this case is hereby continued until 9:30 a.m. February 23, 2024, in New Bern, North Carolina. The parties' deadline to hold a conference under Rule 26(f) in the related case is continued until February 20, 2023. If the parties agree that court-hosted settlement conference would be useful in this instance, they are directed to file in each case a notice to that effect with three dates of mutual availability. TEXT ORDER - This matter comes now before the court upon defendants' motion seeking 30-day continuance of claim construction hearing set for tomorrow in light of ongoing settlement negotiations therein described. Plaintiff has not separately responded to the motion; however, defendants represent plaintiff's lack of consent at present to the relief requested. The court continues claim construction hearing pending hearing on the instant motion by telephone tomorrow at 12:30 p.m., at which time the court will consider impact of ongoing negotiations in this matter and other infringement action (5:23-cv-297).
