MINUTE entry before the Honorable Gabriel A. Fuentes: The Court appreciates plaintiff calling to the Court's attention its mediation statement, sent on 6/4/24 to the Court but apparently inadvertently deleted. The Court has reviewed as well as the defendants' 6/12/24 mediation statement. Unfortunately, neither of these statements was sent to opposing counsel, but only to the Court. Accordingly, the Court's 6/13/24 order (doc. # 65 ) is modified so that plaintiff is ordered to send its mediation statement to defendant forthwith, and defendant's response mediation statement (containing a counterproposal to the settlement proposal in the plaintiff's statement) must be sent to plaintiff (and the Court's settlement correspondence box) on or before the close of business on 6/21/24. All other dates in the 6/13/24 order are vacated. The parties kindly are reminded to read the Court's Standing Order for Settlement conferences, as recently modified, but still requiring mediation statements to be exchanged, not sent only to the Court. MINUTE entry before the Honorable Gabriel A. Fuentes: On this referral for settlement (doc. # 59 ), the mediator ordered that the parties submit confidential settlement statements on 6/7/24 (by plaintiff) and 6/14/24 (by defendant) (doc. # 62 ). The Court ordered these statements as a part of its process to determine the parties' degree of commitment to settlement and compromise before setting aside public time for a settlement conference. The Court also previously ordered the parties to review the Court's Standing Order for Settlement Conferences (doc. # 61 ), available on the Court's website, and specifically directing that the audience for mediation statements are the opposing parties, and not the mediator (who still receives the statements), and directing that the mediation statements must contain concrete monetary and non-monetary proposals to resolve the matter. Unfortunately, no mediation statement at all was received from plaintiff, as far as the mediator is aware. Then, on 6/12/24, the mediator received a mediation statement from the defense, directed only at the mediator, and not containing any concrete settlement proposal but rather a statement of what judicial relief defendant would like to receive in the case, although, in fairness, if there was no opening proposal, the defense had nothing to which it might have responded. Rather than terminate the referral, the Court will give the parties a second opportunity at mediation and to show that they are serious about mediation and settling the matter. First, the parties must actually take the time to read the Standing Order for Settlement Conferences. Second, their mediation statements must comply with that order. Third, to give the parties another opportunity, mediation statements are now due from plaintiff on 6/28/24 and from defendant on 7/12/24. The Court will enter an appropriate order upon review of these statements, if they are submitted. Alternatively, if the parties are not willing to comply with this order, they need not do so, and they may inform the Court by confidential status report due by 6/28/24 that they are not interested in a settlement conference after all, and the referral will be terminated. The parties appear to have resolved this aspect of their dispute and the Court, in its discretion, declines to award damages under the circumstances.
