TX )	ELECTRONIC ORDER: On June 2, 2022, the Court issued an Order staying this case pending ex parte reexamination of U.S. Patent No. 7,523,497. Doc. No. 36. In that Order, the Court instructed the parties to file a written joint status report within ten days of the conclusion of the reexamination. Id. On June 7, 2023, Defendant filed its Status Report, informing the Court of the outcome of the ex parte reexamination. Doc. No. 37. Defendant's Status Report was not filed jointly because, according to Defendant, Plaintiff's counsel did not respond to Defendant's email, phone call, and voicemail. Id. Accordingly, the Court ordered the parties to file a joint status report advising the Court of the parties' respective positions on how to proceed by June 16, 2023. Doc. No. 38. Plaintiff's counsel timely filed the parties' Joint Report. Doc. No. 39. In the Joint Report, Defendant asks the Court to maintain the stay pending the outcome of its forthcoming 12(c) motion. Doc. No. 39. Plaintiff does not specifically address this, and merely says that it is "ready to resume the case." Id. Based on the foregoing, this case shall remain STAYED pending the outcome of Defendant's forthcoming 12(c) motion, which shall be filed no later than August 21, 2023.
