ORAL ORDER re 45 Joint Statement Pursuant to Local Rule 81.2 - In the Joint Statement Pursuant to Local Rule 81.2, Defendant asserts that its motion to dismiss (filed in Texas) "is fully briefed and ripe for consideration." Upon review of the submissions for that motion, it appears that Defendant stated: "Viewpointe requests in the alternative that the Court either dismiss Plaintiff's case for improper venue, transfer the case to the District of Delaware, or dismiss under Rule 12(b)(6) for failure to state a claim upon which relief can be granted." The Texas court chose the second option, transferring the case to the District of Delaware. THEREFORE, Defendant's motion to dismiss has been decided and is not pending before this Court.
