The Court hereby lifts the stay. After discussion by and between counsel for the parties and the Court, the following deadlines were agreed upon, and the Court orders as follows. By February 19, 2025, Plaintiff shall file a dismissal of all its claims against Defendant, with prejudice. By February 19, 2025, Defendant shall furnish to Plaintiff an itemization of its attorney fees as of that date, and identify the fees associated with defending the case in the District Court, and the fees it seeks beyond those incurred defending the matter in the District Court. The deadline for Defendant's completion of depositions is May 6, 2025, and the deadline for filing any motion(s) for summary judgment is June 5, 2025. Any brief in opposition to the summary judgment motion(s) is due 30 days after the filing of the motion(s) and any reply brief is due 14 days after the filing of the brief in opposition. The Court encouraged the parties to agree to participate in mediation and advised that if they decide they would like to mediate the case, they can file a joint motion or request to refer the matter to the magistrate judge for mediation, and the Court will make the referral. Also, Magistrate Judge Parker who previously conducted a mediation has retired, and Magistrate Judge Reuben Sheperd replaced him. 01/24/25 | Order [non-document] The Court has reviewed the status reports filed by the parties. (Doc. Nos. [92] and [93] .) Plaintiff indicates that it "is considering dismissing this lawsuit in the interest of efficient resolution;" that it "believes dismissing its remaining claims would resolve all material issues and bring swift conclusion to this nearly five-year-old suit;" and asks this Court to hold a status conference "to discuss possible dismissal." (Doc. No. 93, PageID #s 3597-98.) Defendant asserts that Plaintiff's "asserted claims of the 585 patent have been adjudged invalid;" the corresponding infringement claims must be dismissed with prejudice;" and that "[t]he asserted claims of the 050 patent, which are broader than those claims already invalidated in the IPR, should be held invalid. Defendant represents that if Plaintiff will not concede that the asserted claims of the 050 patent should be held invalid, then it intends to promptly seek summary judgment of the invalidity of the 050 patent." (Doc. No. 92, PageID # 3589.) Defendant also asserts that Plaintiff's pending motion to amend its infringement contentions (doc. no. [63] ) should be denied, that it has asked Plaintiff to withdraw it, but Plaintiff has not responded. (Id., PageID #s 3592-93.) 10/29/24 | Order [non-document] On December 6, 2021, this Court stayed the instant action pending IPR review of Horizons '585 Patent. On February 29, 2023, the PTAB issued a Final Decision finding all challenged claims of the '585 Patent to be invalid. In April 2023, Horizon appealed to the United States Court of Appeals for the Federal Circuit. See Horizon Global Americas, Inc. v. Northern Stamping Co., No. 23-1767 (Fed. Cir.). The Court lifted the stay in June 2023 for the limited purpose of allowing Defendant Northern Stamping, Inc. ("NSI") to file a supplemental motion for leave to amend its answer and counterclaims, which it did and which the Court granted on October 23, 2023. NSI filed its Third Amended Answer and Counterclaims on November 30, 2023. Otherwise, this matter has remained stayed pending the outcome of Horizon's Federal Circuit appeal.
