FINAL JUDGMENT: NuVasive is not liable for Dr. Jacksons claim of fraudulent inducement. Dr. Jackson breached the covenant not to sue in the parties Amended and Restated Development and License Agreement (the 2014 Agreement) by bringing claims against licensed BOT Implant products sold by NuVasive. Pursuant to the parties stipulation (D.I. [355] ), damages are awarded to NuVasive in the amount of $337,500. Dr. Jackson is not liable for NuVasives counterclaims for (i) breaching the 2014Agreement by asserting patents that meet the definition of Helical Flange, (ii) breaching the implied covenant of good faith and fair dealing, or (iii) unjust enrichment (CASE CLOSED).
