01/18/23 | PAPERLESS ORDER. THIS MATTER is before the Court on 27 the Parties' Joint Motion for Extension of Time for Defendant to File a Reply in Support of its 18 Motion to Dismiss. On November 23, 2022, the Court entered 7 the Order of Referral in this case and ordered the Parties to comply with its Practices and Procedures, which state in relevant part:Absent an emergency, requests for extensions of time must be presented to the Court, by motion, no later than 48 hours prior to the deadline from which the Parties are seeking relief. Sanctions may be imposed for non-emergent requests made less than 48 hours prior to the deadline. All requests for extensions of time must include (1) a list of any prior motions for extension of time, the basis for those requests, and whether they were granted; (2) a specific statement regarding the circumstances necessitating the requested relief; (3) a conferral statement as required under Local Rule 7.1; and (4) a specific period for the relief requested.Notwithstanding these clear instructions, the Parties did not file 27 the Joint Motion for Extension until the day of the deadline for Defendant to file a reply. Furthermore, 27 the Joint Motion failed to include a specific statement regarding the circumstances necessitating an extension or an explanation as to why the Parties did not seek an extension until the day of the deadline. Accordingly, the Court does not find good cause to grant an extension.Based on the foregoing, it is ORDERED AND ADJUDGED that 27 the Parties' Joint Motion for Extension is DENIED. The deadline has passed for Defendant to file a reply in support of its 18 Motion to Dismiss.Finally, the Court notes that the Parties have previously failed to comply with 7 the Order of Referral. The Court will consider the imposition of sanctions for any future violations of the Federal Rules of Civil Procedure, the Local Rules for the Southern District of Florida, the Court's Practices and Procedures, and any Court order.
