(IN CHAMBERS) ORDER RE: DEFENDANTS' MOTION FOR ATTORNEYS' FEES (DKT. NO. [169] ) by Judge John A. Kronstadt: For the foregoing reasons, Defendant has not shown by preponderance of the evidence that it is entitle to fees. Given that Defendant has not satisfied its burden, Plaintiff's other arguments need not b addressed. Defendant's request for fees under section 285 is DENIED. For the same reasons discussed above, fees under the higher standard espoused by section 1927 are not warranted. Plaintiff and its counsel have not conducted proceedings in an unreasonable and vexatious manner. Further, Defendant has not shown why the inherent powers of the Court to award fees should be applied in light of the determinations made as to the normal avenues for granting such relief. Therefore, the request for an award of fees under section 1927and the inherent powers of the Court is DENIED. For the reasons stated in this Order, the Motion is DENIED.
