With respect to [50] [51] PVM's supplemental request for claim construction, the Court adopts the Background and Discussion sections from its previous [49] Claim Construction Order (specifically, pp. 1-12). For the reasons set out in sections A and B of the Argument in [53] PPC's Responsive Supplemental Claim Construction Brief, the Court concludes that (1) PVM's request to define "a body member" as "a one-part body" is untenable, and (2) PVM's request to define "a body member" in contradistinction to the "shell" is also untenable. Furthermore, the Court believes that lay jurors will understand the term "a body member," and so that term needs no further construction. A "member" is just a (single-part or multi-part) component. And even PVM--based on its proposed construction--must believe lay jurors will understand the word "body."
