ORAL ORDER: The Court's summary judgment decision issued on this date dismissed both of the antitrust counterclaims against the plaintiffs as well as all of the remaining counterclaims against plaintiff 10x Genomics. For these reasons the Court believes that a reduction of the time allocated for trial is called for. The previous allocation of 19 hours per side is hereby reduced to 16 hours per side. ORAL ORDER: The parties' stipulation to extend time [636] is approved. At the Court's instance the final pretrial conference date of 1/21/2025 is vacated and reset to 1/27/2025 at 10:15 AM Chicago time. If the parties want an in-person pretrial conference it will be held in Judge Kennelly's Chicago courtroom (as he is unavailable to travel that week or the previous week); otherwise the pretrial conference will be held by video conference. The parties should advise Judge Kennelly's courtroom deputy clerk of their preference by 1/6/2025. The Court further advises that it expects to rule on the pending summary judgment and Daubert motions (which were not fully briefed until 12/13/2025) by 1/3/2025. The trial set for 2/3/2025 will be scheduled as an 8-day jury trial as previously ordered. This is subject to reduction depending on the disposition of the pending summary judgment and Daubert motions. Trial time is limited to 19 hours for plaintiffs in the aggregate and 19 hours for defendant. Because there are multiple plaintiffs they must confer and attempt to reach agreement regarding the allocation of the plaintiffs 19 hours. If plaintiffs cannot reach agreement the Court will adjudicate any dispute at the final pretrial conference. Time spent on jury selection and the jury instruction conference does not count against the allocation of trial time. Time will be counted whenever a party is arguing before the jury or the Court (including on evidentiary objections); questioning a witness; and presenting deposition testimony. On depositions the parties will need to provide the Court with a percentage breakdown for any deposition testimony that is presented to the jury. Opening statements are limited to 40 minutes per side; closing arguments are limited to 75 minutes per side total. All time used on openings and closings counts against the overall allocation; thus the parties would be well advised to consider using less than the total time allowed for openings and closings. Any request to modify any of these time limitations must be made promptly. Counsel are to be present and ready to go each trial day at 8:45 AM. The trial day will run until approximately 5:00 PM. If necessary the jury instruction conference will be held after the jury leaves at the end of a trial day. For the preliminary and final instructions the Court will need the parties to be prepared to project them for the jury when the Court reads them (before opening statements and before closing arguments). The parties should also be prepared to project the FJC patent system video if they wish this to be played for the jury during the preliminary instructions. In preparing the final pretrial order the parties should use the Seventh Circuit pattern jury instructions to the extent they are available for the claims and defenses at issue.
