I held a status conference with Attorneys Noonan and Ogden for the Plaintiff and Attorney Connaughton for the Defendants in the related cases of BTL Industries, Inc. v. Rejuva Fresh LLC, No. 1:23-cv-00032-LEW (BTL 1) and BTL Industries, Inc. v. Rejuva Fresh, LLC, No. 1:24-cv-00139-LEW (BTL 2) in which I indicated that I would (1) grant without objection BTL's motion in BTL 1 to file a second amended complaint (SAC) and reminded BTL to file the SAC separately on the docket thereafter; (2) grant BTL's unopposed motion in BTL 2 to stay its deadline to file a responsive pleading until thirty days after the Court rules on Rejuva's motion to consolidate the two cases, and (3) cancel the Markman hearing scheduled for July 22, 2024, in BTL 1 with a view to rescheduling it following the Court's ruling on the motion to consolidate cases.
