MINUTE ORDER denying Plaintiff's 35 Counter-Motion for Stay of Dismissal Proceedings. On May 2, 2024, Defendants Torralba Properties, LLC and Edward Bravenec moved to dismiss the Amended Complaint on various grounds, including personal jurisdiction and improper venue. ECF Nos. 20, 23. On May 30, 2024, Plaintiff moved for partial summary judgment against all Defendants. ECF No. 30. However, in light of the pending motions to dismiss, the Court stayed all deadlines for all Defendants to respond to the motion for partial summary judgment. See Minute Order of June 12, 2024. As the Court explained, the "general practice is to adhere to the traditional litigation sequence of complaint; answer or motion to dismiss; discovery, if appropriate; and only then, summary judgment." Id. (quoting Comm. on Ways & Means v. Dept of Treasury, No. 19-cv-1974 (TNM), 2019 WL 4094563, at *2 (D.D.C. Aug. 29, 2019)). And here, Plaintiff's motion for partial summary judgment was premature given that the pending motions to dismiss include jurisdictional challenges. The day after the Court entered that Order, Plaintiff filed a 35 Counter-Motion to stay proceedings on the motions to dismiss pending the outcome of the partial summary judgment motion. For all the same reasons explained above, the 35 Counter-Motion to stay is improper because the Court must proceed to resolve jurisdictional challenges before considering any motion for summary judgment. Accordingly, it is hereby ORDERED that Plaintiff's 35 Counter-Motion for Stay of Dismissal Proceedings is DENIED. Signed by Judge Timothy J. Kelly on 7/16/2024. (lctjk2) (Entered: 07/16/2024)

MINUTE ORDER treating as opposed and granting Defendant Torralba Properties, LLC's 32 Motion to Stay Deadline. Plaintiff filed his Amended Complaint on January 8, 2024. One Defendant, the United States, has yet to respond. On May 2, 2024, Defendants Torralba Properties, LLC and Edward Bravenec moved to dismiss the Amended Complaint on various grounds, including personal jurisdiction and improper venue. ECF Nos. 20, 23. On May 30, 2024, just two days after the parties completed briefing on Defendants Torralba Properties, LLC's and Edward Bravenec's motions to dismiss, Plaintiff moved for partial summary judgment against all Defendants. ECF No. 30. "There is power inherent in every court to control the disposition of the causes on its docket with economy of time and effort for itself, for counsel, and for litigants." Aguirre v. S.E.C., 671 F. Supp. 2d 113, 123 (D.D.C. 2009) (internal quotation omitted). Moreover, courts' "general practice is to adhere to the traditional litigation sequence of complaint; answer or motion to dismiss; discovery, if appropriate; and only then, summary judgment." Comm. on Ways & Means v. Dept of Treasury, No. 19-cv-1974 (TNM), 2019 WL 4094563, at *2 (D.D.C. Aug. 29, 2019). Here, Plaintiff's motion for partial summary judgment is premature. Defendants Torralba Properties, LLC and Edward Bravenec have pending motions to dismiss that include jurisdictional challenges, and the United States has yet to respond to the Amended Complaint at all. Accordingly, it is hereby ORDERED that Defendant Torralba Properties, LLC's 32 Motion to Stay Deadline is GRANTED. It is further ORDERED that the deadlines for all Defendants to respond to Plaintiff's 30 Motion for Partial Summary Judgment shall be STAYED until further order of the Court.
