Instead, for the sake of clarity, Plaintiff should file a second amended complaint, not a corrected first amended complaint. Plaintiff attached the draft pleading to its motion, but Plaintiff should now file the amended pleading as a freestanding docket entry. The Court grants Plaintiff leave to file a second amended complaint by January 15, 2021. Based on the motion, the Court assumes that the corrections have no substantive impact, and that the pending motion to dismiss would equally apply to the corrected pleading. So, the Court will treat the pending motion to dismiss (Dckt. No. 32 ) as if it applies to the forthcoming second amended complaint. If any party believes that it makes sense to deny the pending motion to dismiss as moot, and require Defendants to file a motion to dismiss the second amended complaint, then that party can file a motion.
