10/20/24 | ORDER deferring ruling on [36] - In Defendants' motion (Dkt. No. [36] ), Defendants argue that the operative complaint should be dismissed because Plaintiff's counsel was not admitted to practice before this Court at the time the complaint was filed. Further, Defendants argue that Plaintiff withdrew its willful infringement claim. In Plaintiff's opposition to Defendants' motion to dismiss, Plaintiff "stipulates to dismissal without prejudice subject to its ability to seek amendment of its complaint and infringement contentions to assert willfulness and enhanced damages based on information gained in discovery." Dkt. No. [37] at 4. In light of Plaintiff's stipulation, and given that discovery is ongoing, Plaintiff is sua sponte granted leave to file a second amended complaint by October 23, 2024. In light of the anticipated second amended complaint, and in light of the fact that Plaintiff's attorneys have been approved to appear pro hac vice in this matter (see Dkt. Nos. [12] , [31] ), Defendants shall file a letter by October 24, 2024 explaining on what grounds, if any, Defendant's motion should not be denied as moot. Alternatively, Defendants may file a letter, by October 24, 2024, withdrawing their motion to dismiss, without prejudice. Additionally, in advance of the November 14, 2024 settlement conference, the parties shall submit updated ex parte settlement letters to Judge Marutollo's chambers via email (marutollo_chambers@nyed.uscourts.gov) by November 1, 2024.
